LuKuai Intellectual Property Rights Protection Policy
LuKuai places great importance on the protection of intellectual property rights and complies with applicable laws, regulations, and binding regulatory requirements concerning intellectual property rights.
LuKuai supports legitimate and authorized content and takes measures against copyright infringement and other intellectual property violations.
In accordance with applicable laws, regulations, and regulatory requirements, LuKuai has established the following procedures and measures to protect the legitimate rights and interests of intellectual property rights holders.
When a rights holder discovers that content on a third-party website linked through a URL provided by LuKuai infringes upon their legitimate rights and interests, the rights holder should first submit a “Rights Notice” to LuKuai. Upon receiving a valid notice, LuKuai may take appropriate measures in accordance with applicable laws and regulations, including removing relevant content from its services or blocking the relevant link.
Rights Notice
Any individual or organization may submit a Rights Notice to LuKuai if both of the following conditions are met:
- The rights holder believes that a network user has infringed upon their legitimate rights and interests through online services.
- Content on a third-party website linked through a website navigation link provided by LuKuai infringes upon the legitimate rights and interests of the rights holder.
The individual or organization should submit the Rights Notice to LuKuai by email.
Please note: If the statements contained in the Rights Notice are false or inaccurate, the person submitting the notice shall be responsible for all legal liabilities arising from the false or inaccurate notice, including but not limited to compensation for related expenses and attorney’s fees.
If the individual or organization is uncertain whether material available online infringes upon their legitimate rights and interests, LuKuai recommends consulting a qualified professional before submitting a Rights Notice.
To enable LuKuai to effectively process a Rights Notice, please provide the following information in the format below, including the item numbers:
- Proof that the rights holder owns the trademark rights, copyrights, and/or other legally enforceable rights relating to the allegedly infringing content.
- Provide a sufficient and clear description of the content that you believe infringes upon your legitimate rights and interests, together with the URL of the third-party website where the allegedly infringing work or content is published.
- Clearly identify which specific content on the allegedly infringing webpage infringes upon the rights and interests identified in Item 2.
- Provide the rights holder’s specific contact information, including name, a copy of an identity document or passport for an individual, or a copy of the organization’s registration certificate for an organization, as well as mailing address, telephone number, fax number, and email address.
- Provide the location of the allegedly infringing content on the Internet, such as the webpage URL or the specific location on the webpage where the allegedly infringing content appears. This information will allow LuKuai to contact the owner or administrator of the webpage containing the allegedly infringing content.
- The Rights Notice must include the following statements regarding the authenticity of the information provided:
(1) I am the lawful rights holder of the content identified in this complaint.
(2) The content published on the third-party webpage identified in my complaint infringes upon my corresponding legitimate rights and interests.
(3) I acknowledge that if the information contained in this Rights Notice is not completely true and accurate, I will bear all legal liabilities arising from it.
- The Rights Notice must also include the following statement:
“I guarantee that the information provided in this notice is sufficient, truthful, and accurate. I am the lawful rights holder of the content identified in this complaint, or I have been duly authorized and have the right to exercise the rights and interests identified in Item 2.”
